When an order is placed, it will be shipping to an address designated by the purchaser as long as that shipping address is compliant with the shipping restrictions contained on this website. All purchases from this website are made pursuant to a shipment contract. As a result, risk of loss and title for items purchased from this website pass to you upon delivery of the items to the carrier. You are responsible for filing any claims with carriers for damaged and/or lost shipments.

These Terms and Conditions will be governed by and construed in accordance with the laws of the Province of Alberta, without giving effect to any principles of conflicts of laws. Any action seeking legal or equitable relief arising out of or relating to this website shall be brought only in the courts of the Province of Alberta. A printed version of these Terms and Conditions shall be admissible in judicial and administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

14. TERMINATION. 
You or we may suspend or terminate your account or your use of this Website at any time, for any reason or for no reason. You are personally liable for any orders that you place or charges that you incur prior to termination. We reserve the right to change, suspend, or discontinue all or any aspect of this website at any time without notice.

15. UNDERAGE USERS.
To become a member of Elevate Auctions, individuals must be 18 years of age or older. If we learn that we inadvertently have collected identifying personal information from an individual under the age of 18, we will promptly delete that information from our system. If you believe another member is underage, please report their user name to info@elevateauctions.com.

16. CREDIT CARD TRANSACTIONS.
We use BeanStream / TD Canada Trust Payment Gateway to process credit card orders. We supply them with data for credit card authorization and fraud detection only and they are restricted from using the data for any other purposes. In order to create an account on this website a valid credit card number is required. Elevate Auction completes a pre-authorization of the user’s credit card in the amount of $1.00 at the time of registration. Elevate Auctions does NOT store your credit card on file.

17. FEES AND TAXES
Certain taxes and government charges may be payable in relation to the purchase transaction. We accept no responsibility for such taxes and other government charges on transactions on the website.

18. ELEVATE AUCTIONS IS A VENUE
We are not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to pay for items. We cannot ensure that a buyer or seller will actually complete a transaction. In the event that you have a dispute with one or more affiliates, you release Elevate Auctions (and our its subsidiaries and joint ventures and all such person's, officers, directors, agents and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

19. BIDDING AND BUYING
As a buyer, you are obligated to complete the transaction with the seller if you are the highest bidder at the end of an auction (meeting the applicable minimum bid or reserve requirements) and your bid is accepted by the seller. By bidding on an item you agree to be bound by the conditions of sale included in the item's description by the seller so long as those conditions of sale are not in violation of this Agreement or otherwise unlawful. Bids are not retractable except in exceptional circumstances such as when the seller materially changes the item's description after you bid, or a clear typographical error is made.

In order for Elevate Auctions to verify your user details, we will perform a pre-authorization transaction of $0.50 on your credit card. The amount will not be deducted from your account but could possibly show up on your transaction summary for a couple of days.
